I wanted to make sure you saw the statement I released this week about Joe Biden’s newest unconstitutional gun grab! Not only does his attack on homemade firearms violate our 2nd Amendment, but the entire way the ATF operates is against Article 1, Section 1 of the Constitution. Instead of passing gun laws through Congress, anti-gun leftists have used the ATF to rule by executive power. “Opinion letters” and “rule clarifications” claim to change U.S. gun laws, but Congress never approved it!
It’s time to shut down the unconstitutional actions of the ATF and stop Biden’s assault on our rights. You can be sure that Raphael Warnock will be a rubber stamp vote for Biden’s radical ATF nominee, but you can be just as sure that as your next Senator, I will fight to uphold our Constitution and protect our precious liberty!

Biden’s ATF Usurps Article I Constitutional Authority
Firearm Definition Changes, ATF Nominee Are Bad News for Liberty
Flowery Branch, GA: U.S. Senate candidate Josh Clark released the following statement in response to President Joe Biden’s proposed gun control measures and nomination of Steve Dettelbach to head the Bureau of Alcohol, Tobacco, Firearms, and Explosives:
“The Biden Administration’s latest gun grab is an assault on not only our vital 2nd Amendment rights, but Article 1, Section 1 of the Constitution itself. Our governing document makes clear who the lawmaking entity is at the federal level and it is NOT the Biden administration or their executive agencies. Biden’s new rules against homemade firearms and his pick for director of the ATF are both blatant, unconstitutional power grabs from the Executive Branch.
“I could focus at length on the longstanding legality of homemade firearms. I could also spend much time about the political motivations of Steve Dettelbach and how he’s just as unfit to serve as the failed nominee David Chipman. At the foundation of this push for restricting our 2nd Amendment, however, is the fundamental proposition that the ATF and all of Biden’s bureaucratic agencies are not the lawmaking branch of government!
“Article 1, Section 1 of our miraculous Constitution states plainly that ‘all legislative powers herein granted shall be vested in a Congress of the United States…’ It is the job of the House and Senate to make laws, not the President and not unelected bureaucrats! For too long the ATF has acted as a legislative body. They have contorted and expanded the National Firearms Act and the Gun Control Act of 1968 by ‘rule’ and ‘opinion’ to make sweeping changes to laws on firearms and firearm ownership. This is plainly unconstitutional!
“I will lead the fight in the U.S. Senate for Congress to reclaim their constitutional authority from the White House. We must check and balance out-of-control enforcement agents who manipulate U.S. law to match their political agenda. It’s time to shut down the unconstitutional actions of the ATF and return legislating to representatives of We the People!”
